Belcher Secures Early Dismissal for Employer

Reggie represented a life insurance company and two of its managers.  The company employed Plaintiff as a sales agent in North Carolina.  After the company fired her, she sued the company and two managers alleging sexual harassment, sex and race discrimination, retaliation, and violation of the Family and Medical Leave Act.  Suit was brought in the Western Division of the Eastern District of the U.S. District Court for North Carolina.  Plaintiff sought over $400,000.   Defendants won this case on an early motion to dismiss, contending that Plaintiff failed to plead the requisite standards on each claim.  In this case, the court gave Plaintiff several extensions of time to respond more fully, but she was unable to counter the arguments that we presented in our Memorandum of Dismissal.  The company and both managers won the entire lawsuit on the Motion to Dismiss.
