Julian Allen and Jennie Smith Obtain Defense Verdict

Plaintiff alleged that Defendant tried to run over her with a car, causing a comminuted wrist fracture and ligament rupture.  The parties were neighbors and had ongoing animosity for approximately a year leading up to the accident.  More specifically, Plaintiff alleged that Defendant had harassed her on a consistent basis (swearing, yelling, gesturing, honking, etc.).  Plaintiff brought claims for negligence, gross negligence, assaultand battery, and outrage.  Julian and Jennie were able to obtain summary judgment on the outrage cause of action before trial, and the battery claim was dismissed on directed verdict.  The total medical bills were approximately $52,000 after surgery.  Plaintiff boarded approximately $800,000 in closing. The jury returned a verdict for Defendant.
