Matthew Rhett Cook

Matt Cook’s legal practice is exclusively devoted to Workers’ Compensation. Matt has over 10 years of Workers’ Compensation experience. In addition to serving as an advocate, Matt is a licensed certified Mediator and concentrates his mediation practice on Workers’ Compensation matters. Matt approaches each case with an understanding of the many intricate nuances surrounding workers’ compensation litigation. He understands that being involved in litigation is a complex and unsettling experience for individuals and businesses alike, and with that in mind, he works closely with clients to accommodate their needs and objectives, determining the most effective and efficient way to quickly resolve a case through prompt communication and aggressive legal strategy. His familiarity with the South Carolina Workers’ Compensation Act combined with his knowledge of the operations of his clients’ businesses enables him to counsel his clients on the best ways to approach each case.

Matt defends employers, third party administrators, insurance carriers, large corporations, small businesses and individuals, against claims filed by injured workers. Matt is very aware of the high stakes involved in workers’ compensation cases, from traumatic brain injury, complicated spinal injuries, reflex sympathetic dystrophy (RSD), insurance coverage issues with multiple employers, subrogation liens, Medicare Set-Aside issues, occupational exposure, chemical/hazardous materials exposure, repetitive trauma, third party claims, appeals, depositions, mediation, among others, and works with clients to quickly assess their specific situation so their case can be quickly resolved. Matt’s clients can expect timely communication, excellent client service, and can trust the knowledge and advice provided.

Matt’s work includes advising and strategizing with employers on work safety in an effort to be pro-active towards claims by attempting to make a safer work environment with fewer and less significant injuries. He often assists his clients in developing and updating their workers’ compensation claims procedures and practices. Matt makes himself available for clients to offer advice on a variety of claim issues. Matt conducts in person meetings with employers. His clients include trucking and transportation companies, package delivery services, distribution facilities, hospitals, private security firms, restaurant chains, retail outlets and construction firms. Matt prides himself on listening to his clients in order to discern their needs and the most appropriate solutions. Matt always has his eye on his clients’ best interests.

“Albert Einstein said, ‘Our defense is not in our armaments, nor in science, nor in going underground. Our defense is in law and order.’ It is through the law that my clients are afforded protection of their rights.”

Representative Matters

Workers’ Compensation

  • Represented a national trucking company in an alleged workplace accident filed by a claimant who contended that she was injured while entering her work truck. Matt worked closely with the third party administrator and employer, and he conducted discovery that revealed contradictory evidence. Through rigorous cross-examination, the claimant was found to be not credible and her claim for benefits was denied.
  • Defended a local manufacturing employer in a repetitive trauma claim that resulted in a favorable outcome for Matt’s employer/carrier. An appeal was filed and mediation ensued. Matt worked closely with the local employer representative and was able to reach a successful resolution at mediation.

The following is a testimonial from one of Matt’s clients.  The result Matt achieved for the client does not necessarily indicate that similar results can be obtained in the future.

“I was exceptionally impressed with Matt Cook's representation on a matter for our company. His work was some of the best I have ever seen, and I have attended mediations with some of the country's very best attorneys. I have been an attorney for 30 years, worked in private practice at large law firms where we conducted mediations on very complex commercial litigation, and I later handled the commercial litigation docket as in-house counsel for a Fortune 500 company, where I attended numerous mediations. I also mediated cases while a litigation attorney for the U.S. government. During all those years of mediation experience, I have rarely seen an attorney who was as prepared and as proficient as Matt. He walked that very fine line of being an excellent advocate of our position, yet was compassionate and understanding toward the claimant so that we were able to achieve an excellent result. Matt's introductory presentation was the best that I have ever heard. He deftly explained the process and our position, all while convincing the former employee that his best option was to resolve the matter during the mediation. It was stellar work, and a pleasure to have attended the mediation with Matt.”
